1. Acceptance of Terms
By accessing or using the Sengard platform ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
2. Description of Service
Sengard provides a cloud-based security awareness training platform that includes security awareness training modules, phishing and social engineering simulations, AI-powered risk assessment, dark web monitoring, compliance training, gamification features, and analytics dashboards. The specific features available to you depend on your subscription plan.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials
- You must provide accurate and complete registration information
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
- Organization administrators are responsible for managing user access within their organization
4. Acceptable Use Policy
You agree not to use the Service to:
- Conduct actual phishing attacks or social engineering against individuals outside your organization
- Collect credentials or personal information for malicious purposes
- Violate any applicable laws, regulations, or third-party rights
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Share your account credentials with unauthorized individuals
- Use the Service to harass, intimidate, or discriminate against employees
- Attempt to access data belonging to other organizations
5. Phishing Simulation Terms
Sengard's phishing simulation features are designed exclusively for authorized security awareness testing within your organization. By using these features, you represent and warrant that:
- You have proper authorization to conduct simulated phishing campaigns within your organization
- Simulations will only target employees of your organization who have been properly notified of the security awareness program
- You will comply with all applicable laws regarding electronic communications and employee monitoring
- Simulation results will be used constructively for training purposes, not for punitive action against employees
6. Intellectual Property
The Service, including all content, features, and functionality, is owned by Sengard and is protected by international copyright, trademark, patent, and other intellectual property laws.
Your subscription grants you a limited, non-exclusive, non-transferable license to access and use the Service for your organization's internal security awareness purposes. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
7. Data Ownership
You retain ownership of all data you submit to the Service ("Customer Data"). You grant Sengard a limited license to use Customer Data solely for the purpose of providing and improving the Service. We may use anonymized, aggregated data for research, benchmarking, and product improvement purposes.
8. Payment and Subscription
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by applicable law
- We reserve the right to change pricing with 30 days' notice
- Failure to pay may result in suspension or termination of your account
- Free trial periods are subject to separate terms and may be limited in features
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENGARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to Sengard in the twelve (12) months preceding the claim.
10. Termination
Either party may terminate the subscription with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the Service ceases, and we will retain your data for 90 days before permanent deletion, unless otherwise required by law.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
